These Terms & Conditions set out the basis on which The Bute Woodspoiler supplies handmade wooden goods through this website and governs your use of the site itself. Please read them carefully before placing an order.

By using this website, placing an order or requesting a bespoke commission, you agree to be bound by these Terms & Conditions together with any additional policies referred to on this page, including our Privacy Policy and Customer Care information.

The Bute Woodspoiler is an independent artisan woodturning workshop based on the Isle of Bute, Scotland, creating small-batch and bespoke wooden pieces.

In these Terms & Conditions, unless the context requires otherwise:

  • “we”, “us”, “our” means The Bute Woodspoiler.
  • “you”, “your” means the person purchasing goods or using this website as a consumer.
  • “goods” means any physical products made available for sale on this website, including bespoke or personalised items.
  • “order” means a request by you to purchase goods from us, whether placed through the online shop or agreed directly for a bespoke commission.
  • “website” means www.thebutewoodspoiler.uk and any related pages under our control.
  • “business day” means a day other than a Saturday, Sunday or public holiday in Scotland.

You can place an order by adding items to your basket and following the checkout steps, or by contacting us directly for bespoke commissions. Please check all details carefully before submitting your order.

After you place an order, you will receive an acknowledgement by email. This confirms that we have received your order but does not mean it has been accepted. A legally binding contract is formed only when we send you a further email confirming dispatch of the goods, or when we confirm in writing that we accept your bespoke commission and (where applicable) your deposit.

We may decline or cancel an order before dispatch if, for example, the goods are unavailable, we cannot obtain authorisation for payment, there has been a pricing or description error, or we reasonably believe the order to be fraudulent or in breach of these Terms. In such cases, any payment taken will be refunded.

You are responsible for providing complete and accurate information when placing an order, including your contact details, delivery address and any personalisation text. Please review confirmations carefully and contact us promptly if something is incorrect.

All prices for goods are shown in pounds sterling (GBP) and are for the item only unless we clearly state otherwise. Delivery charges and any optional extras will be shown separately before you confirm your order.

We are a small artisan business. If we are required to charge VAT or any similar sales tax, this will be made clear at checkout or on your invoice. You are responsible for any customs duties, import taxes or local charges applied by authorities outside the United Kingdom.

We accept the payment methods shown at checkout. Payment is normally taken at the time you place your order, or at the time we confirm a bespoke commission and request a deposit.

We take care to ensure prices are correct, but occasionally a genuine error may occur. If we discover an obvious pricing mistake before dispatch, we are not obliged to supply the goods at the incorrect price. We will contact you to confirm whether you wish to proceed at the correct price or cancel your order and receive a refund.

Available delivery options, estimated timescales and charges are shown during checkout and explained in more detail on our Customer Care page. Any delivery dates given are estimates and are not guaranteed unless we expressly agree otherwise in writing.

Risk in the goods passes to you when they are delivered to the delivery address you provide, or when you (or a carrier organised by you) collect them from us. Please inspect parcels on arrival where reasonably possible and inform us promptly of any issues.

You are responsible for providing a complete and accurate delivery address and for ensuring someone is available to accept delivery where required. If a delivery is returned to us because of an incorrect address or repeated failed delivery attempts, we may need to charge for re-delivery.

Ownership of the goods passes to you only when we have received full payment, including any delivery charges and, where relevant, deposits in respect of bespoke work.

Nothing in these Terms affects your statutory rights as a consumer under applicable law.

For most ready-made goods purchased at a distance, you may have a legal “cooling-off” period starting from the day after you receive the goods during which you can cancel your order. Full details, including how to exercise this right, are explained on our Customer Care page.

Bespoke, made-to-order or personalised items are usually exempt from the standard cooling-off rules. Once we have begun work on such an item in accordance with your confirmed instructions, you may not be able to cancel without charge. We will always explain this clearly when agreeing a commission.

If you wish to cancel, return or request a refund, please contact us with your order details and reasons. Goods should generally be returned in unused condition, with reasonable care taken to protect them in transit. Refunds will normally be made using the same payment method you used for the original transaction and within a reasonable time after we receive the returned goods or, where applicable, evidence that they have been sent back.

Each piece we make is handcrafted, often from characterful Scottish and European hardwoods. Natural variations in grain, colour, knots and small movement in the timber are part of the material and are not faults.

We take care to describe and photograph goods accurately, but colours and appearance may vary slightly between screens and in different lighting. Measurements are approximate and minor variations may occur in handmade work.

If a product description includes specific information about features, finishes or recommended uses, please read this carefully before purchasing. If you are unsure whether a piece is suitable for a particular purpose, you are welcome to contact us for advice before placing your order.

We are responsible for loss or damage you suffer that is a foreseeable result of our failing to comply with these Terms or our failing to use reasonable care and skill. We are not responsible for any loss or damage that is not foreseeable or that results from your misuse or improper care of the goods.

We do not exclude or limit in any way our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence or for your rights in relation to faulty goods.

We will not be liable for any delay or failure to perform our obligations where this is caused by an event outside our reasonable control, such as extreme weather, disruption to transport or utilities, accidents, illness, strikes, fire, flood or similar events. If such an event affects your order, we will contact you as soon as reasonably possible to let you know and will take reasonable steps to minimise the effect of the delay.

All rights in the designs, images, text, logos and other content on this website (including photographs of our work) are owned by or licensed to The Bute Woodspoiler. They are protected by copyright and other intellectual property laws.

You may view and print pages from the website for your own personal, non-commercial use only. You must not copy, reproduce, publish, distribute, modify or use any part of the website content, including our product photographs and designs, for any commercial purpose without our prior written permission.

Purchasing a physical piece from us does not give you any rights in the underlying design, image or concept, which remain our intellectual property unless we expressly agree otherwise in writing.

You agree to use this website only for lawful purposes and in a way that does not damage, disable, overburden or impair the site or interfere with anyone else’s use and enjoyment of it.

You must not attempt to gain unauthorised access to the website, the server on which it is stored or any connected systems, nor introduce viruses, malware or other harmful code. You must not use the website to transmit or post any material that is unlawful, offensive, defamatory or otherwise objectionable.

We may suspend, restrict or terminate your access to the website at any time if we reasonably believe you have breached these Terms or engaged in misuse of the site.

Links from this website to third-party sites are provided for convenience only. We do not have control over, and are not responsible for, the content or practices of those sites. Your use of any third-party site will be subject to its own terms and policies.

These Terms & Conditions, and any disputes or claims arising out of or in connection with them or with your purchase of goods from us, are governed by the laws of Scotland.

If you are a consumer, any dispute will be subject to the non-exclusive jurisdiction of the Scottish courts. This means that you can bring a claim in Scotland or, if you live elsewhere in the United Kingdom, in the courts of your home jurisdiction. We may also bring proceedings in your country of residence.

We may update or amend these Terms & Conditions from time to time, for example to reflect changes in our business, products or applicable law. When we do so, the revised version will be posted on this page with an updated date.

The Terms & Conditions that apply to your order are those in force at the time you placed the order, unless a change is required by law or regulatory authority. Where a change is significant and affects existing customers, we will take reasonable steps to draw it to your attention, for example by updating notices on the website.
